"Bad guy" 50 years ago, nice guy now. But no compensation.
Eriş Akman, a screen star from years past, noticed while watching the TV
show "Kara Sevda" in 2015, that in the show scenes from the movie
"Aile Şerefi" that he played in along with Münir Özkul, Adile Naşit, Itır
Esen and Şevket Altuğ in 1976, were used in the show. An 85-second
scene from "Aile Şerefi" was used in the TV show and 8 seconds of that
involved Akman's character "Oktay" saying "I'm mad as hell at that guy!",
"That cuckold has ruined everyone's life!" and "He thinks he owns
everything!"
Akman filed a petition with the court complaining that people were
making unfavorable comments about the "bad guy" character "Oktay"
that he brought to life in the film and that he was feeling bad about this,
asserting that the scenes were used in the TV show without his permission.
He demanded 1,000 TL in material damages and 50,000 TL in
psychological damages from the TV show's producers.
Akman declared that the scenes of his image, his talent and his fame
were used to acquire unwarranted gain, that his rights had been
violated and that his honor and reputation had been impinged. In
its response, however, the court ruled that negative comments about
"Oktay" reflected a superlative performance by Akman in that the
viewing public believed the character he created and rejected
his claim for compensation, essentially ruling that any negative
comments about "Oktay" were compliments for Akman.
A very believable "bad guy".
