'Uncouth' Ex-Ankara Mayor Loses Suit

In 2013, former Ankara Mayor Melih Gökçek sued a teenager who
tweeted "Uncouth Melih Gökçek" after Gökçek had publicly said
to a woman "have you had a lot of abortions done?" The teenager
has now been acquitted by the Ankara 3rd Children's Court, citing
the case of a Polish mayor who lost a similar suit, as a precedent,
and the acquittal has been approved by a higher court, the 'Yargıtay'.
The case involving the Polish mayor, who was jailed for theft. came
about when a Polish journalist referred to the mayor as the "Robber
Mayor", prompting the mayor to file suit. The journalist was jailed
for the 'insult' but on appeal to the European Court of Human Rights
(ECHR) the ECHR ruled that the mayor, being a public figure, must
be more tolerant of criticism and the journalist was freed.
The Turkish court ruled similarly that "by comparison, criticisms
directed at politicians are more prevalent than for private citizens
and this is a principle that has settled into domestic and international
law. Politicians have knowingly acceded to being subjected to close
scrutiny from the public and the press. Consequently, they must be
much more tolerant of criticism."
Ankara's beautification now bequeathed to future generations.
