Despite not being a doctor, H.Ö was accused of providing treatment for
panic attacks, depression and other illnesses, in addition to applying
psychotherapy, Transcranial Magnetic Stimulation (TMS) and other
methods of psychological treatment to patients.
Based on complaints from citizens, the Psychology Association's
Antalya office alerted the public prosecutor about H.Ö.'s activities.
After an investigation, H.Ö. was given a sentence of 1 year 8 months
in jail but the court converted the sentence to an 80 TL (about 10 cents)
fine. (!)
The investigation by the Antalya Provincial Health Directorate noted
that H.Ö. had a "Human Behaviors Science" diploma from abroad,
along with a "Psychotherapy Training Implementer" certificate. In
the back room of his office, H.Ö. was providing TMS services that
only psychiatric experts with a doctors degree are allowed to provide.
In court, H.Ö. declared that "I'm an expert in behavioral science. I
did my masters degree in anger-control. My wife is a doctor and we
opened an office together called Sağlık Hizmetleri (Health Services).
I'm not involved in any treatments that require a doctor to perform.
I did not commit the crimes I'm accused of and I want to be acquitted."
The court did, however, convict H.Ö. and sentenced him to a jail
term of 1 year 8 months and 4 days. However (!), the court instead
converted the jail sentence to an 80 TL (10 cents) fine, based
on the "hükmünün açıklanması geri bırakılması" provision
("postponement of the announcement of the verdict" - essentially,
stay outta trouble and you won't go to jail).
Nevertheless, H.Ö. is still sharing videos from his clinic of himself
administering TMS to patients.
