The lawsuit that has brought businessman Nadir D. and his son Orkun
D. (33) face to face was opened last week in an Istanbul court. The suit
was brought by Nadir D. and Orkun D.'s former lawyer Korak K.
Based on the documents, expert witness reports, HTS (telephone
traffic) records and screen images, nearly 20 individuals are accusing
Orkun D. of "digital defamation."
The story began six years ago when Orkun D. was tried in Çorlu
district of Tekirdağ province. In that case, Orkun D. was tried for
having put the photos and contact information of his former girlfriend
B.A. on some escort service websites (!). In the aftermath of Orkun
D.'s conviction in that case, problems began to arise between him and
many others, including family members.
Father Nadir D. has told the court that his son is a computer expert,
who has posted allegations about Nadir D. being a smuggler of
historic works and a scammer. Nadir D. stated that "because of these
posts, the police and customs officials have raided my house 4 times.
I can't work among my peers anymore and I've lost my reputation
with my friends. I'm afraid that an incriminating item will be
planted in my home. My son needs treatment, he should be under
observation."
Orkun D.'s former lawyer Korak K. told the public prosecutor that
"At the time we were on good terms, he accessed my computer
remotely. He had my camera for a while, too, and copied many of
my photos and files. He wrote 'pedophile, deviant' under one
photo I took of my son in the bathtub. He posted other things about
me having scammed the company I work for and as a consequence
I was taken into custody for a night in Marmaris when I went there
on business. I was released after they realized what was going on
but my life has been a real nightmare for a few years now."

Software expert Orkun D. was asked to vacate a house by his
grandmother S.D. so he wrote on social media that she had
"poisoned her husband to get 10 million TL in wealth." and
he put a picture of her home in Kadıköy, Istanbul, on the internet,
noting that she lives in the house alone. With regard to his aunt
N.Ç., whom Orkun D. claims asked him for 400,000 TL, he
posted that she, her husband İ.Ç. and their daughter D.Ç. are
arms smugglers and leaders in FETÖ (Fethullah Gülen Terror
Organization).
Orkun D. has also posted negatively about prosecutor B.Y.Ç.,
judicial information specialist A.T., Istanbul policeman B.A.,
sports trainer M.Y., dentist S.Ş. and lawyers Y.A. and C.B.
The prosecutor in question told Hürriyet that Orkun D.
posted that the prosecutor "takes bribes and is cooperating with a
prostitution ring." He told Hürriyet that "this guy should be
followed 24 hours because he keeps on committing crimes.
Some of the websites he's made are foreign-sourced so I can't
have the posts taken down. One time my boss at another
courthouse said to me 'did you see the news in the paper?' -
I had to get an expert witness report to clear my name. The
first case involving him (Orkun D.) that I saw was about a
woman whose photos and phone numbers were shared
inappropriately. She tried to commit suicide. I talked with
the concerned prosecutor, who said he was reluctant to
start an investigation about him (Orkun D.) When I asked
why, he said 'I'm afraid of this fellow.'"
Prosecutor Cüneyt Özcan is asking for a sentence of between
7.5 and 28 years for Orkun D., who denies all the charges.
